TERMS OF USE

Article 1 – Purpose

1.1 The purpose of the present Terms of Use is to define the terms and conditions of registration and participation in AcadeMYO consisting in the access of around forty pre-recorded lectures and three half-day interactive sessions broadcast live on Monday July 5th, Wednesday July 7th and Friday July 9th, 2021 (hereinafter the "Event") offered by Association Institute of Myology (hereinafter “AIM”), a French non-profit organization, with its principal office located at Groupe Hopsitalier Pitié Salpetrière Bâtiment Babinski 47-83 Boulevard de l’hôpital, 75013 Paris, France.

1.2 The Terms of Use constitutes the entire and unique agreement between AIM and the participant (hereinafter the "Parties"), they cancel and replace any previous agreement relating to their object.

Article 2: Acceptance and modification of the Terms of Use

2.1 Any registration to the Event implies the full acceptance of the participant to the version of the present Terms of Use in force on the day of the participant's registration and obliges him/her to strictly comply with it.

2.2 The present Terms of Use as well as any new version are accessible from www.academyo.fr/Privacy-Policy/Terms.

2.3 AIM reserves the right to proceed, at any time and without any possible recourse on the part of the participant, to any modification of the present Terms of Use.

2.4 These modifications are binding on the participant as soon as they are online. It is therefore the responsibility of the participant to regularly consult the Terms of Use available at all times on the site. Any use of the services after modification of the Terms of Use, is worth tacit acceptance by the participant of the new Terms of Use.

Article 3: Prices and payment

3.1 All prices are quoted exclusive off tax and are therefore subject to the current VAT rate of 20% if applicable. All prices are in euros.

If the participant has not attended or has only partially attended the Event, the payment is due in full.

All prices are all-inclusive and include any educational materials provided during the Event.

3.2 It is understood that AIM reserves the right at any time:

  • to refuse any registration or participation in the Event by a participant (or his/her replacement) who is not up to date with his/her payments in full;
  • to refuse any registration from a person for legitimate and non-discriminatory reasons;
  • to exclude at any time any participant whose behavior would hinder the smooth running of the Event and/or would be in serious breach of these Terms of Use;
  • to exclude any participant who has made false declarations at the time of registration, without compensation.

3.3 DUNE Interactive as a service provider for AIM, acts on behalf of AIM for payment. Participants may pay for their registration to an Event according to one of the three following payment methods:

  • By Credit Card via a secure payment
  • By PayPal
  • By Bank Transfer

The participant is solely responsible for the payment by credit card, PayPal or bank transfer of his registration fee to the Event. AIM or DUNE Interactive are not responsible for payment problems linked to the malfunctioning of the e-commerce service.

Article 4: Modification / Cancellation / Replacement

4.1 Any modification of the registration or cancellation must be made in writing and sent by e-mail to the following address contact@academyo.fr.

In case of cancellation, the registration fee will be refunded to the participant, less the amount of administrative costs (bank fees, management fees of DUNE Interactive and VAT).

4.2 AIM reserves the right, in case of material impossibility and/or if the number of participants to an Event is deemed insufficient, to cancel the Event at the latest 10 (ten) calendar days before the date of the Event. If the participant does not wish to postpone his/her registration to, the registration fees previously paid will be fully refunded.

Article 5: Intellectual property

5.1 AIM is the exclusive holder of all intellectual property rights attached to the distinctive signs of the site " www.academyo.fr " (hereinafter the " Distinctive Signs "), as well as all the rights relating to both the structure and the content of the said sites (including the texts, photos, illustrations, videos, hypertext links, video, etc).

5.1.2. The whole of the elements constituting the content of the Event (texts, graphics, software, photographs, images, videos, sounds, names, logos, marks, creations and various protected works, data bases etc...) (Hereinafter the “Content”) is subjected to the French and international legislations on the copyright and in particular the articles L.111-1, L.122-4 and L.122-5 of the French code of the intellectual property.

5.1.3 These elements are the exclusive property of AIM, except the elements realized by external contributors who did not transfer their copyright.

5.2 These Terms of Use do not entail the transfer of any intellectual property rights to the participant on any of the rights mentioned above.

5.3 Each participant is expressly prohibited from reproducing and/or using the Distinctive Signs and the Content, as well as from modifying, adapting, copying, translating, reproducing, selling, publishing, exploiting and disseminating in any form and by any means whatsoever all or part of the structure and/or content of the said sites and Content, with the exception of the acts strictly necessary for visiting the said sites and registering for Events.

5.4 The participant also agrees not to integrate all or part of the Content of the Event into a third-party site, except with the prior written and express authorization of the person responsible for the Content. In case of acceptance, the resumption of any Content of the site will have to be the object of will have to be the subject of a mention referring to the author.

5.5 Any contravention of the present stipulations without the prior and express written authorization of AIM is prohibited, and is likely to constitute an act of counterfeiting and/or unfair or parasitic competition or intellectual property theft giving rise to civil and/or penal sanctions.

Article 6: Image rights

6.1 Within the framework of the Event, the participant authorizes AIM to be filmed / and photographed free of charge and authorizes AIM to use his image in the context of activities of AIM. 

6.2 Consequently, and in accordance with the provisions relating to image rights and personality rights, the participant authorizes AIM to fix, reproduce and communicate to the public the photographs/videographs representing the participant in the context of the Event.

6.3 These photographs/film/videographs will be used, i.e. reproduced and represented, in full or in excerpts, solely to illustrate the Event and for communicating about AIM’s activities. These videos/photographs may be used for a period of five (5) years, in particular:

- by and on all electronic communication networks, such as the Internet (AIM's website, its Facebook page, its LinkedIn...)

- in paper publications.

6.4 AIM undertakes to ensure that this use does not infringe on the privacy, reputation, dignity or integrity of the participant.

6.5 The participant understand that he/she can revoke its authorization at any time by contacting contact@academyo.fr.

Article 7: Applicable law and jurisdiction

7.1 These Terms of Use are subject to French law.

7.2 Any dispute arising from the validity, interpretation or performance of these Terms of Use shall be submitted, in the event of failure of a prior attempt to find an amicable solution, to the exclusive jurisdiction of the courts of the jurisdiction of France.
